A discussion of the principle of the “child’s best interest” in legal adjudication is the topic of this essay. My main claim is twofold: first, that a non-trivial use of the principle implies adjudication of pre-existing rights, and secondly, that the application of the principle implies a duty of identification of the norm that contains the adjudicated right.Resumen:El presente artículo reflexiona sobre el papel que desempeña el principio del “interés superior del niño”, contenido en la Convención Internacional de Derechos del (...) Niño, en el razonamiento jurídico justificatorio. Dos ideas fundamentales son defendidas en él. Por un lado, que un uso no trivial del principio de interés superior significa adjudicación de derechos preexistentes, lo que implica ubicarse en un contexto de aplicación, es decir, con uso de los criterios dogmáticos y precedenciales pertinentes. Por otro lado, que la aplicación del principio y su utilización como premisa de justificación, supone identificar el tipo de norma en que se contiene el derecho adjudicado, lo cual proyecta requerimientos específicos en la explicitación del argumento justificatorio. El objetivo de esta investigación fue determinar el nivel predictivo de los factores técnico-docentes de la enseñanza media en el éxito académico en una universidad estatal chilena, desagregado en tres variantes: tiempo de titulación, rendimiento académico y relación titulado-desertor de cada carrera.Metodológicamente, se realiza un análisis descriptivo y correlacional, aplicando modelos de regresión. Se consideraron como factores técnico-docentes el colegio de proveniencia, la modalidad educacional y el promedio de notas.Los resultados indican que existe baja correlación entre las variables predictoras y (...) el rendimiento universitario y los análisis de regresión muestra un bajo nivel predic- tivo las variables predictoras. Partiendo de un pasaje de una obra de Shakespeare, se revisará el papel de la fidelidad en la configuración de la identidad personal. el artículo se centra en dos tendencias principales en la concepción de la misma, enraizadas en la comprensión narrativa del yo: la fidelidad como permanencia frente al cambio y la fidelidad como apertura y avance hacia aquello que hace ser, que da unidad y sentido. Pero el yo se descubre en ambos casos dividido, necesitado de narrar para (...) ser, luchando con el tiempo, ya se presente como amenaza o como obstáculo para ser uno y distinto. la alternativa que aquí se propone consiste en una fidelidad como retorno a lo esencial, donde el ser y la unidad del yo permanecen, en tanto que éste se abre a la novedad de aquéllo fundamental. dicha apertura consiste básicamente en un diálogo, en el cual el yo recibe y entrega lo propio, poniendo en juego su ser en el espacio dramático, actualizando así cada vez el yo, su unidad y su sentido. Quality of language comprehension determines performance in all kinds of activities including academics. Processing of words initially develops as auditory, and gradually extends to visual as children learn to read. School failure is highly related to listening and reading comprehension problems. In this study we analyzed sex-differences in comprehension of texts in Spanish in three modalities presented to 12–14-years old students, native in Spanish. We controlled relevant cognitive variables such as attention, phonological and semantic fluency and speed of processing. Girls’ (...) comprehension was similar in the three modalities of presentation, however boys were importantly benefited by dual-modality as compared to boys exposed only to visual or auditory text presentation. With respect to the relation of text comprehension and school performance, students with low grades in Spanish showed low auditory comprehension. Interestingly, visual and dual modalities preserved comprehension levels in these low skilled students. Our results suggest that the use of visual-text support during auditory language presentation could be beneficial for low school performance students, especially boys, and encourage future research to evaluate the implementation in classes of the rapidly developing technology of simultaneous speech transcription, that could be, in addition, beneficial to non-native students, especially those recently incorporated into school or newly arrived in a country from abroad. El siglo XX fue una centuria de grandes descubrimientos científicos y desarrollos tecnológicos en todas las áreas, pero en particular en lo relativo a la conquista del espacio. Durante años, la bioética fue pensada en estrecha relación con la ética médica y el ámbito de problemas específicamente humanos, pero en los últimos tiempos su sentido se ha ido ampliando. El presente trabajo busca relacionar esta preocupación por una ciencia de la supervivencia con la existencia de la llamada basura espacial o (...) chatarra espacial que orbita la Tierra, y que en un tiempo no conocido afectará pequeñas o grandes áreas de nuestro planeta. La basura espacial se ha convertido en una preocupación cada vez mayor, especialmente en los últimos años, puesto que las colisiones a velocidades orbitales pueden producir aún más basura espacial en el proceso llamado síndrome de Kessler, o cascada de ablación, lo que perjudicaría el funcionamiento de los satélites, afectaría las misiones espaciales o pondría en riesgo la vida de los astronautas. También es probable que dicha basura se precipite sobre la Tierra, con efectos no claramente evaluados sobre la población humana. Aunque el problema suele aparecer tanto en textos científicos como en obras de ciencia-ficción, no ha sido considerado con la seriedad exigida para un riesgo real y no alejado de la vida cotidiana. Este interrogante nos conduce, atravesando el fuego positivo de la duda, a veces de tintes narrativos, hasta un espacio y un tiempo capaces de vestir al yo, de darle una voz y un gesto únicos, capaces de regalarle un nombre. Un teatro será ese lugar donde Yo puedo ser y donde vengo a ser Yo, porque en él se puede representar una acción esencial. El tratamiento doctrinal de la seguridad jurídica es relativamente reciente. Es, pues, así un problema jurídico moderno que empieza -dice el autor que comentamos en Hobbes. Y que, a pesar de que yo, sobre esto, tengo mis dudas, debo de reconocer también, sin embargo, que la abundante problemática sobre la seguridad jurídica, o cuestiones adyacentes, no se remonta más allá del siglo de este autor. Y, ¿a qué se debe el interés, aun reciente, por el tema? Debo de recordar al (...) respecto que el interés sobre el derecho giró sólo, hasta entonces, sobre el derecho trascendente: El derecho debía de materializar la justicia y punto. Das Buch untersucht die Bedeutung des Begriffs rationalitas bei Hildegard von Bingen. Zunachst wird die Herkunft des Begriffs von der griechischen Logoslehre uber die fruhchristliche Trinitatsspekulation bis hin zur ratio-Rezeption des Fruhmittelalters beleuchtet. Auf diesem Hintergrund entfaltet der zweite Teil die anthropologisch-theologische Bedeutung von rationalitas fur das Weltbild Hildegards.

Higher education institutions worldwide have begun to embrace sustainability issues and engage their campuses and communities in such efforts, which have led to the development of integrity and ethical values in these organizations and their relationships with stakeholders. This study provides a literary review of the concept of University Social Responsibility (USR) and sustainability programs worldwide, grouped into eight research streams: conceptual framework, strategic planning and USR, educating on USR, spreading USR, reporting and USR, evaluation of USR, barriers and accelerators (...) and case studies. Nowadays, Artificial Intelligence (AI) is present in all sectors of the economy. Consequently, both data-the raw material used to build AI systems- and AI have an unprecedented impact on society and there is a need to ensure that they work for its benefit. For this reason, the European Union has put data and trustworthy AI at the center of recent legislative initiatives. An important element in these regulations is transparency, understood as the provision of information to relevant stakeholders to support (...) their understanding of AI systems and data throughout their lifecycle. In recent years, an increasing number of approaches for documenting AI and datasets have emerged, both within academia and the private sector. In this work, we identify the 36 most relevant ones from more than 2200 papers related to trustworthy AI. We assess their relevance from the angle of European regulatory objectives, their coverage of AI technologies and economic sectors, and their suitability to address the specific needs of multiple stakeholders. Finally, we discuss the main documentation gaps found, including the need to better address data innovation practices (e.g. data sharing, data reuse) and large-scale algorithmic systems (e.g. those used in online platforms), and to widen the focus from algorithms and data to AI systems as a whole. Ignorance is often a perfectly good excuse. There are interesting debates about whether non-culpable factual ignorance and mistake subvert obligation, but little disagreement about whether non-culpable factual ignorance and mistake exculpate. What about agents who have all the relevant facts in view but fail to meet their obligations because they do not have the right moral beliefs? If their ignorance of their obligations derives from mistaken moral beliefs or from ignorance of the moral significance of the facts they have in (...) view, should they be excused for failing to meet their moral obligations? It is not obvious that they should. In this paper we argue that the best non-skeptical accounts of moral responsibility acknowledge that factual ignorance and mistake will diminish moral responsibility in a way that moral ignorance and mistake will not. That is because factual ignorance is often non-culpable so long as it meets certain merely procedural epistemic standards but the same is not true of moral ignorance. Our argument is that the assumption that it is gets the standards of culpability for moral ignorance wrong, and that the mistake is encouraged by the thought that culpability in general requires an instance of known wrongdoing: that acting wrongly requires de dicto unresponsiveness to one’s obligations at some stage. We deny this and conclude that, therefore, ignorance and mistaken belief are indeed often perfectly good excuses – but far less often than some philosophers claim. (shrink)

The clinical empiricism of Thomas Sydenham (1624–1689) and his definition of especie morbosae represented a substantial turn in the medicine of his time. This turn supposed the shift towards an ontological conception of diseases, from a qualitative to quantitative interpretation. Sydenham’s clinical proposal had a great influence on empiricism philosophical thinking, particularly in John Locke and his delimitation of knowledge. The dialogue between medicine and philosophy, set out by Sydenham-Locke, reactivates the problem of the clinical and theoretical foundations of medical (...) thought, as well as the limits of scientific knowledge. Similar to problem exposed in the Hippocratic treatise On ancient medicine, seventeenth-century medicine seeks its epistemological foundations and the solution to its difficulties in clinical experience, probability and analogy. The aim of this work is to show the Sydenham’s contribution to one of the great controversies between medicine and philosophy. (shrink)

The conception of contagious disease that Girolamo Fracastoro provides in his work De contagione et contagiosis morbis, marks the origin of modern epidemiology and microbiology. This conception puts into play the Galenic and Aristotelian traditions of research, faced with its own conceptual limitations of the growing mechanistic thought of the time. According to Fracastoro, epidemic diseases spread by invisible living germs called seminaria, begotten by corrupted humours. Fracastoro resorted to the old notions of "sympathy" and "antipathy" to respond to questions (...) about how seminaria is transmitted from one body to another, and what is the specificity that limits its transmission to certain species and organs. Like Galileo and Descartes, Fracastoro tries to establish a dialogue in the field of medicine between the Aristotelian vitalism and the modern mechanistic perspective. The purpose of this paper is to highlight the ideological, theoretical and conceptual assumptions, both philosophical and scientific, assumed by Fracastoro with regard to the problem of contagion. The aim of this work is to discuss "Darwinism: its past, its present, its future", a lecture given in 1875 by Miranda Azevedo as one of the "Popular Lectures of the Gloria Neighborhood, Rio de Janeiro". In this lecture Azevedo elaborates the concepts of evolution, human evolution, progress and the idea of man as the pinnacle of evolution and the master of the selective laws governing nature. We will analyze the article, published in 1876, that contains the full text of (...) Azevedo's lecture. Of particular importance is his affiliation to Haeckel, something already commented on in Brazilian historiography. But, unlike other studies devoted to the theme, I will examine in detail Azevedo's text, attempting to show how he relates hereditary and selective evolutionary processes to thinking about how future Brazilian generations could progress. The article investigates from the book “Images despite everything”, by Georges Didi-Huberman (2020), four remaining photographs of Crematorium V in Auschwitz-Birkenau, taken in August 1944, by the Greek Jew Alberto Errera, a member of the Sonderkommando. It is noteworthy that it is his photographic gesture invested with the most intense emotional sense (pathos) that gives his images an indicial character that effectively operates as testimony (superstes) allowing one to imagine what is considered “unimaginable” by “Holocaust metaphysicians”. Reacting to the thesis (...) of the impossibility of representing the gas chambers, according to which any attempt to configure them would be a falsification of suffering by concession to aestheticization, the article states that it is necessary to know what is possible, whatever it is about the pain that took place there. It is also evident that it is the “zones of opacity” in Alberto Errera’s photos that, by conveying the pathos, activate the imagination and force the viewer’s thoughts. It is its “out of framing” that, mobilizing the gaze without stopping, from the icon to the index and from that to that, does not operate as an interdiction, but, on the contrary, it is what makes one see and know something more about what happened there. Finally, it can be concluded that Alberto Errera’s gesture transformed the “historical reality”, made of horror and upheaval, into a possibility of memory for the future, using only a remnant of celluloid. The aim of this work is to present the thesis “On the Ontogenetic Evolution of the Human Embryo in its Relations with Phylogenesis,” by Affonso Regulo de Oliveira Fausto, published in Brazil in 1890. To our knowledge, it was one of the first Brazilian academic works focused specifically on evolution. It was also the first doctoral thesis that addressed the topic of recapitulation in order to analyze what was then called the progressive evolution of the human species in tandem with (...) the embryological development of the individuals that would constitute the Brazilian “type.” In the present work, we analyze the author’s thesis in relation to its sources, concepts, as well as the country’s political context at the time of its publication. Fausto’s text, in which he explicitly recognized the influence of Ernst Haeckel’s recapitulation theory, represents a window to understand better a concept of nation based on science and on the idea of inexorable progress that was accepted in Brazil at the end of the nineteenth century. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

This essay aims to explore imitation in social contexts. The argument that summarizes my claim is that the perception of other people’s behaviour conditions the agent in imitating that behaviour, as evidence from social psychology holds :893–910, 1999; Bargh and Ferguson in Psychol Bull 126:925–945, 2000; Bargh and Ferguson in Trends Cogn Sci 8:33–39, 2004), but what the agent perceives and experiences becomes potential motives for her actions only through her identification with a particular way of being and acting. Therefore, (...) although the agent’s actions are conditioned by perceptual stimuli, the latter are not the cause of the actions. The agent is the ultimate cause. That is, a convergence between perceptual stimuli and conscious will. I take this latter conclusion to suggest a compatibilist approach whereby action in a social situation would require the perceptual conditioning as much as the freedom and consciousness of the agent. Krausists followed a dialectical method in all their activities. It is an action plan in which theory and practice are established on a continuum. Since it summarizes all human activity, this dialectic implies a philosophy of action. The originality of this article lies precisely in offering an account of the philosophy of action implicit in the work of Krause, which has never before been made explicit. Therefore, the goal of this article is, on the one hand, to isolate this dialectic (...) in the texts of the Spanish Krausists, and, on the other hand, to demonstrate the traditional affirmation about the practical meaning of Krause’s philosophy, as shown in its Spanish version. This practical orientation of his thought was channelled through several disciplines and, especially, through the modern pedagogy known as active education. Throughout the article, I also show how to relate Krause’s philosophy to contemporary philosophical debates. (shrink)

From the thirties "sinarquismo" became an important sociopolitic and socioideological strength in contrast with the Mexican posrevolutionary political system. This article makes an attempts to give and answer to some questions : what was the "sinarquismo" origin and development? Under what bases did it take root socially, politically and ideologically speaking?. How was "sinarquismo" linked to the global context of conservative, catholic and right-winger movements? And what was the story of the "sinarquista" movement in the middle occident of Mexico?

We uncover fundamental dimensions of the process through which organizations embed the practice of fraternity through embarking on an organizational journey in the direction of the common good. Building on the latest encyclical of Pope Francis, _Fratelli Tutti_, about fraternal and social friendship, we offer insight into the understanding of what it means to become a fraternal organization and reflect on the key ethical and paradoxical challenges for organizations aiming at collectively contributing to the common good. We add to previous (...) work by characterizing this journey as a process involving unique ethical challenges that emerge from the paradoxes associated with this process and how this might change the nature of the relationships between organizations and others within the organizational landscape. El artículo reconstruye las nociones de origen y estructura en el pensamiento de H. Rombach y analiza la significación ontológica y el riesgo antropológico del fenómeno del origen. Primeramente, el análisis indica por qué el origen significa el modo ontológico-trascendental primordial de génesis del ser y resulta irreductible a y presupuesto por las nociones de "fundamento", "causa eficiente" o "inicio". Luego elucida la significación estético-ontológica propia del modo de originar del origen. The removal of water from mines was one of the key issues that former miners had to deal with. Roman colonists brought new technology to the Iberian Peninsula that addressed this problem. However, they did not invent this technology because it had already been applied to the growth of other endeavours in the Hellenistic society throughout the Eastern Mediterranean. In the mine, the Archimedes screw, waterwheels, bucket pulleys, and Ctesibius pumps were the primary drainage systems. In this essay, the primary (...) characteristics, and modes of operation of machines are examined. Without leaving out the most significant finds made in the southwest of the Iberian Peninsula, one of the regions with the longest history of mining exploitation. To serve as a foundation for future research in this field, this work compares the primary mining mechanisms in ancient Huelva on a qualitative and quantitative level by the implementation of a TOPSIS methodology, a multi-criteria decision analysis method. What are the testicles and who should we talk to to find out? What structures of women’s bodies are left over and what are missing? What matters in a body? Starting from Donna Haraway’s invitation to narrate «naturoculture» stories, in this article I am interested in how subaltern bodily narratives of intersex people and their companions change expert biologic knowledge, overflowing the classic dualisms of the clinic. I propose to read biology inside the «contact zone» in order to explore the (...) remaking of the body that extend or reconfigure expert imaginaries. This crafting approach to biological knowledge leads to treating expert objects as the provisional result of meaning negotiation processes. I argue that conceptualizing such objects as biological crafts allows us to expand the material cultures of biology to enable other bodies through conversations outside of expert/layman and nature/culture logics. Relational Quantum Mechanics is an interpretation of quantum theory based on the idea of abolishing the notion of absolute states of systems, in favor of states of systems relative to other systems. Such a move is claimed to solve the conceptual problems of standard quantum mechanics. Moreover, RQM has been argued to account for all quantum correlations without invoking non-local effects and, in spite of embracing a fully relational stance, to successfully explain how different observers exchange information. In this work, (...) we carry out a thorough assessment of RQM and its purported achievements. We find that it fails to address the conceptual problems of standard quantum mechanics—related to the lack of clarity in its ontology and the rules that govern its behavior—and that it leads to serious conceptual problems of its own. We also uncover as unwarranted the claims that RQM can correctly explain information exchange among observers, and that it accommodates all quantum correlations without invoking non-local influences. We conclude that RQM is unsuccessful in its attempt to provide a satisfactory understanding of the quantum world. (shrink)
